1. Privacy Statements

We at CVH believe in protection of data as a fundamental right of an individual and no matter what personal data protection acts and principles including and extending beyond General Data Protection Regulation (“GDPR”) have put to the center of our core values.

In our role as Cloud Service Provider, we take responsibility for providing you with uniform and compliant standards for personal data privacy.

CVH is committed to ensuring that your privacy and personal data are protected. We will use your personal data in accordance with the applicable laws and regulations.

2. Controller and Data protection officer

CVH is the ‘controller’ and as such responsible for the processing of your personal data. You can reach us for general questions by e-mail at contact@cvh.com.

Individuals also have the right to access and erase their personal data that CVH may hold. Request it by e-mail at contact@cvh.com

3. Activities, in which we process your personal data

CVH may collect your Personal Data when:
  • You visit our website
  • You order a service from CVH
  • You participate with CVH in any of its ongoing promotional offers.
  • You participate in a CVH survey.
  • You subscribe to a CVH newsletter
  • You submit an abuse notification to CVH.
  • You ask CVH for more information about a CVH service, or contact CVH with a question, comment or complaint.
  • You use the CVH network, CVH infrastructure and/or other CVH services.
  • In order to offer our services, performing sales contracts, evaluating clients through fraud-prevention agencies, referral partners, business directories and credit reference agencies CVH collects your personal data.

    WHAT KIND OF INFORMATION CVH MAY COLLECT ABOUT YOU IN OUR ROLE AS DATA CONTROLLER
    CVH may collect the following information about you:
  • Your name, (business/private) address, phone number, date of birth, email address and personal identification numbers.
  • Your CVH account information – such as services you ordered, domain name registration information, the IP addresses assigned to you, your customer ID, service charges owed and received, the use of CVH services or any other information related to your account.
  • Information about your payment method, such as credit card number, bank account number or other banking information.
  • Your contact with CVH – such as a call record, a chat record when you engage in a chat session with CVH, an email or letter you send to CVH or other records of any contact you have with CVH.
  • WHY CVH PROCESSES YOUR PERSONAL DATA?

    CVH processes your Personal Data for the following purposes:

  • Processing of Orders and Sales Contracts and provision of services, including full customer verification
  • Conducting market research with the aim of entering into a customer relationship and/or maintaining, renewing or extending a customer relationship and offering discounts.
  • Communicate with you
    1. to provide information about services
    2. to provide information about offers, Orders and Sales Contracts, provision of services, order status and payment,
    3. to provide support and maintenance services,
    4. to handle complaints,
    5. to answer questions from (potential) customers.
  • Process Your Transactions, including
    1. calculating, invoicing and collecting of service Fees,
    2. processing financial transactions regarding the acceptance of Orders, and
    3. granting debt collection rights to third parties.
  • Investigating creditworthiness and risk management, including prevention of overextending credit to (potential) customers and verifying whether (potential) customers will be able to comply with financial obligations.
  • Investigating and processing suspected violations of CVH’s Policies.
  • Ensuring the security of persons, goods and objects, and performing fraud detection.
  • Conducting legal processes, including
    1. conducting legal proceedings, and
    2. collecting evidence for civil legal proceedings relating to you.
  • Complying with statutory obligations, including
    1. Provision of data to authorized authorities in the context of criminal investigations,
    2. Complying with (applicable) data retention obligations, and
    3. The provision to third parties of Data concerning customers in connection with an infringement of these third parties’ rights.
    Establishing the identity of customers or third parties, including in relation to the provision of access to data centers and our offices.

    CVH retains personal data only for so long as necessary to fulfill the purposes for which it was collected, including as described in this Privacy Policy or in our service-specific privacy notices, or as required by law.

    SHARING YOUR PERSONAL DATA WITH THIRD PARTIES IN OUR ROLE AS DATA CONTROLLER

    Service Providers.

    CVH may engage third parties to act as our service providers and perform certain tasks on our behalf, such as processing or storing data, including personal data, in connection with your use of our services and delivering products to customers. CVH service providers are obligated to handle personal data consistent with this Privacy Policy and according to our instructions. They cannot use the personal data we share for their own purposes and must delete or return the personal data once they've fulfilled our request.

    Partners.

    At times, CVH may partner with third parties to provide services or other offerings. CVH requires its partners to protect your personal data.

  • Debt collection agencies or other debt recovery organisations.
  • Law enforcement agencies, regulatory organisations, courts or other public authorities to the extent required by law.
  • A third party that has claimed that your use of the CVH services violates the CVH’s Policies or applicable laws (to the extent such sharing is required by law).
  • In certain situations, CVH may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
  • CVH IN ITS ROLE AS SUB- PROCESSOR

  • This section explicitly deals with Personal Data hosted, transmitted or processed on infrastructure owned by you or leased from CVH. The customer of CVH that owns or has leased CVH infrastructure, will be responsible for determining the purposes and means of the processing of Personal Data, and this CVH customer (or its customers) will be the data controller in regards to such processing.
  • CVH shall be a data sub-processor, if at any time CVH has access to personal data stored on infrastructure owned by a CVH customer or leased from CVH, and any actions performed by CVH in relation to such data shall be solely governed by the agreement concluded between CVH and its customer.
  • Consent

    we may rely on your consent to use your Personal Data for certain direct marketing purposes to third parties that cannot be qualified as the following: prospects that granted consent in an earlier stage, customers, supplies, consultants or other contractual relationships.

    You are entitled to withdraw your consent at any time by giving us notice. Upon receipt of a notice where your consent is withdrawn, we will without undue delay stop processing your Personal Data if and to the extent it is required and permitted under law.     TECHNICAL AND ORGANISATIONAL SECURITY PROCEDURES AND DATA TRANSFERS In

    We believe that great privacy rests on great security. We use technical, administrative, and physical safeguards to protect, prevent unauthorized access to, and the misuse of your Personal Data keeping in line with international data protection laws, in particular the GDPR.

    Only authorized personnel are permitted to access Personal Data in the course of their work. Our business processes apply a series of security services that are compliant with the industry security standards, including ISO 27001 and PCI DSS.

    CVH has implemented the following, but not limited to, generic information security measures across its organisation:
    1. network segmentation
    2. next generation firewalls
    3. anti-virus software
    4. full disk encryption of end-points
    5. encrypted communication via SSL or VPN
    6. Security Information and Event Management solutions
    7. dedicated Security Operating Centre
    8. security awareness training,
    9. secure disposal facilities of confidential information, periodic pentesting of public facing services,

    As per need or communication, additional security measures can be implemented.

    In our role as data sub-processor, CVH can provide to its customers a Data Processing Agreement (DPA) as required under the GDPR. If you as an EU customer supplier, or partner specifically require a Data Processing Agreement with CVH, please contact us using the contact details below.

    DATA P ROTECTION OFFICER (DPO)

    Our DPO is positioned in our head quarter in CVH, Delhi, India. This office serves as our international center of expertise for international data protection laws compliance, in particular GDPR compliance.

    RIGHTS

    A number of rights have been accorded regarding your Personal Data of your business and the processing thereof:

  • If you wish to know what personal data has been processed.
  • You can view and, if necessary, change your Personal Data in your account at any time in case duly required.
  • You also have the right to be forgottenobtain from us by requesting to erase your Personal Data in case and to the extent duly required and permitted.
  • In addition, you may, have the right to restriction of the processing of your Personal Data in case and to the extent duly required and permitted under certain circumstances.
  • You have the right to object, on grounds relating to your particular situation, at any time to processing of your business Personal Data.
  • You have the right to receive your Personal Data, which you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller when the processing is based on your consent or is necessary for the performance of a contract (data portability).
